In just the past few years, the National Environmental Policy Act of 1969 (NEPA) and the associated statute issued by the White House Council on Environmental Quality (CEQ) have undergone significant changes.
Most recently, CEQ released on July 31, 2023, the draft of their proposed Phase 2 revisions to the CEQ NEPA Implementing Regulations. This followed CEQ's 2022 completion of their Phase 1 revisions; both rulemakings include reversals to the CEQ regulations changes directing NEPA practice made by the former US Administration in their 2020 rulemaking for changes to regulations, as well as some new permitting reform and acceleration changes. In addition, on June 3, 2023, the current US President signed into law the Fiscal Responsibility Act of 2023, which for the first time ever Congress made numerous substantive changes and additions to the NEPA Statute itself.
